DatePals Privacy Policy

This Privacy Policy describes how DatePal, Inc. (“DatePals,” “we,” or “us”) collects, uses, discloses, and otherwise processes information about you. This Privacy Policy applies to information we collect when you access or use our websites, mobile applications, and other online products and services that link to this Privacy Policy (collectively, our “Services”) and when you otherwise interact with us online, such as through our customer support channels or on social media. We may provide different or additional notices of our privacy practices for certain offerings, in which case those notices will supplement or replace the disclosures in this Privacy Policy.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. If we make material changes, we may provide you with additional notice (such as by adding a statement to the Services or sending you a notification). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.

  1. 1. Collection of Information

    The information we collect about you depends on how you interact with us. In this section, we describe the categories of information we collect and the sources of this information.

    Information You Provide to Us

    We collect information you provide directly to us. For example, we collect information directly from you when you create an account, make a purchase, fill out a form or respond to a survey, submit or post content through our Services (including user-generated content), communicate with us via third-party platforms, participate in a contest, sweepstakes, or promotion, sign up for marketing communications from us, request customer support, or otherwise communicate with us. The types of information that we collect directly from you include the following:

    • Account & Contact Information: name, phone number, email address, and social media handle.
    • Demographic & Location Information: birth month and age, sexual orientation, gender, ethnicity, languages spoken, zodiac sign, hometown, and current neighborhood or suburb.
    • Background & Lifestyle Information: education background, professional background, height, workout preferences, political affiliations, religious affiliation, parental status, and family plans.
    • Dating Preferences & Personality Information: relationship status, dating intentions, partner preferences, and self-reported personality traits, a photo of yourself, and any other information you choose to provide.
    • Verification Data: In order to help maintain the safety of our Services, with your consent, our third party service provider collects a photo of your ID and a selfie photo to extract facial data (“Facial Data”) to verify your age, confirm that you are not a registered sex offender, and are not on our ban list for violation of our Terms of Service or community guidelines or other policies. In some states, the information collected could be considered “biometric data.” Please see the below Biometric Information Policy. If you make a purchase from us, we work with a third-party payment processor to process your payment information.
    • Event, Peer & Match Data: We also ask you to provide information regarding your preferences with respect to other users of the Services, including attractiveness, personality rankings, match desires and post-event and peer feedback.

    Information We Collect Automatically

    We automatically collect information about your interactions with us or our Services, including:

    • Transactional Information: When you make a purchase, we collect information about the transaction, such as ticket or event details, purchase price, and the date and location of the transaction.
    • Device, Usage, and Activity Information: We collect information about how you access our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, browser type, unique device identifiers, app version, crash reports, buttons clicked or actions taken within our mobile app, and device settings. We also collect information about the route by which you access our Services, access dates and times, and your activity on our Services, such as pages viewed, and links clicked.
    • Audio Recordings and Chat Content: If you contact customer service through our chat feature or by phone, we may monitor and retain those conversations, including for training purposes.
    • Information Collected by Cookies and Similar Tracking Technologies: We use tracking technologies, such as cookies, pixels, session replay technology, and SDKs to collect information about your interactions with the Services and our marketing communications. These technologies help us improve our Services and marketing communications, personalize your experience, and analyze your interactions with us, including to see which areas and features of our Services are popular and count visits.     Information We Collect from Other Sources

    We obtain information from other sources. For example, we may collect information from other users of the Services, including attractiveness and desirability ranking and feedback regarding date experience. If you join as a couple, we receive information about you from your significant other such as your relationship with them. We also receive information from our identity verification service provider and payment processor confirming status of identity verification and payment processing.

    Information We Derive

    We may derive information or draw inferences about you based on the information we collect. For example, we may infer your interest in certain individuals based on the results of surveys and your interactions.

    We use the information we collect to:

    • Provide, maintain, and improve our Services, including to develop and train our AI models that power our Services;
    • Process and fulfill your ticket or event orders;
    • Develop new products and services;
    • Personalize your experience with us;
    • Send you technical notices, security alerts, support messages, and other transactional or relationship messages;
    • Send you marketing communications (see the Your Choices section below for information about how to opt out of these communications at any time);
    • Monitor and analyze trends, usage, and activities in connection with our products and services;
    • Target advertisements to you on third-party platforms and websites (for more information and to opt out, see the Targeted Advertising and Analytics section below);
    • Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards;
    • Detect, investigate, respond to, prosecute, and help protect against security incidents and other malicious, deceptive, fraudulent, or illegal activity, and help protect the rights and property of DatePals and others;
    • Comply with our legal and financial obligations; and
    • Create de-identified and aggregate data that cannot reasonably be linked to you.
  3. 3. Targeted Advertising and Analytics

    We engage others to provide analytics services, serve advertisements, and perform related services across the web and in mobile applications. To do this, DatePals and these partners may use cookies, pixels, SDKs, and similar technologies to collect information about your use of our Services and other websites and mobile apps, including your device identifiers, IP address, web browser and mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, order information, and conversion information. This information is used to deliver advertising targeted to you on other companies’ websites and mobile apps, understand the effectiveness of this advertising, analyze and track data, determine the popularity of certain content, and better understand your activity.

    You can also learn more about interest-based ads or opt out of having your web browsing information used for behavioral advertising purposes by companies that participate in the Digital Advertising Alliance, by visiting www.aboutads.info/choices. Your device may also include a feature that allows you to opt out of having certain information collected through mobile apps used for behavioral advertising purposes.

  4. 4. Disclosure of Information

    We disclose information about you as described in the Targeted Advertising and Analytics section above and in the following scenarios:

    • Vendors and Service Providers. We make personal information available to our vendors, service providers, contractors and consultants who perform services on our behalf, such as companies that assist us with web hosting, user verification, payment processing, fraud prevention, customer service, analytics, and marketing.
    • Other Users, the Public. If you create a Single Swap, your name and photo, along with your partner’s name and photo, will be visible to account holders and non-account holders who have access to the swap link. When you create an account on the Services and join a group, other users of the Services within the same group will be able to see information about you including your first name, photo, and information visible on your profile. If you and another user both express a desire to have another date with each other, we will share your designated contact information with the other user.
    • Law Enforcement Authorities and Individuals Involved in Legal Proceedings. We disclose personal information in response to a request for information if we believe that disclosure is in accordance with, or required by, any applicable law, regulation, or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
    • To Protect the Rights of DatePals and Others. We may disclose personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of DatePals, our users, the public, or others.
    • Professional Advisors. We disclose personal information to our legal, financial, insurance, and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
    • Corporate Transactions. We disclose personal information in connection with, or during negotiations of, certain corporate transactions, including a merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
    • Corporate Affiliates. Personal information is disclosed between and among DatePals and our parents, affiliates, subsidiaries, and other companies under common control and ownership.
    • With Your Consent or at Your Direction. We make personal information available to third parties when we have your consent or you intentionally direct us to do so.

    We also disclose aggregated or de-identified information that cannot reasonably be used to identify you. We maintain and use this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

    Mobile Information Sharing

    Notwithstanding any other provision in this Privacy Policy, no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

  5. 5. Biometric Information Policy

    In order to help maintain the safety of our Services, our third-party service provider collects images of your ID and Facial Data from a selfie photo you submit in order to determine whether they are a match so that it can verify your identity, determine your age, and confirm that you are not a registered sex offender. As explained above and in the consent you provide to collect this information, Facial Data may be considered biometric information in some jurisdictions. DatePals does not collect or have access to Facial Data. Rather, our service provider generates Facial Data and permanently destroys it in accordance with its retention schedule. See our service provider’s Biometric Policy for information about how it collects and retains Facial Data. Our service provider retains a copy of your ID and selfie photo on our behalf for 2 years. Facial Data is used solely as described herein, and our service provider does not sell Facial Data.

    We store personal information associated with your account for as long as your account remains active. We store other personal information for as long as necessary to carry out the purposes for which we originally collected it and for other business purposes explained in this Privacy Policy.

    Account Information

    You can access, correct, and delete certain information stored within your DatePals account at any time by logging in and navigating to the profile tab in the app.

    Cookies and Similar Tracking Technologies

    DatePals uses cookies and similar tracking technologies, as described above. You can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect some of the functionality of our Services.

    Communications Preferences

    You may opt out of receiving text messages or promotional emails from DatePals by following the instructions in those communications. If you opt out, we may still send you non-promotional emails, such as those about your account or ticket purchases.

    Mobile Push Notifications

    With your permission, we may send push notifications to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.
