Hero Couple Reward Program

1. 1. Definitions

   • App means the DatePals mobile application and related web experience described in the Terms of Service.
   • Hero Couple means two DatePals account holders who have paired their accounts as partners in the App and have been selected by Sponsor to host a Singles Swap.
   • Singles Swap or Swap means an invitation created in the App through which a Hero Couple and the people they invite pool single friends for a DatePals group dinner.
   • Invite Chain means everyone who joins a Swap through the Hero Couple’s invite link, including people invited by others who joined through that link.
   • Qualified Single means a person who (a) joined the Swap through its Invite Chain, (b) completed a DatePals profile, (c) completed DatePals identity verification, and (d) is not a member of the Hero Couple and does not share a household with either partner. Each person counts once per Swap regardless of how many times they were invited.
   • Reward means the gift card described in Section 5, with a face value of $100.

2. 2. Program Period

   The Program begins on the Last Updated date above and continues until Sponsor ends it. Sponsor will post any end date on this page at least 14 days in advance. Any Swap whose invitation period opened before the posted end date remains eligible under these Rules.

3. 3. Eligibility

   To be eligible to earn a Reward, both members of a Hero Couple must, at the time the Swap’s invitation period opens and when the Reward is delivered:

   • be at least 18 years old and legal residents of the United States;
   • reside in a metropolitan area where DatePals currently operates (as of the Last Updated date, the Chicago, Illinois metropolitan area);
   • hold DatePals accounts in good standing that satisfy the eligibility requirements in Section 1 of the Terms of Service; and
   • have paired their accounts as partners in the App.

   The following people are not eligible: officers, directors, employees, and contractors of Sponsor; employees and contractors of Sponsor’s software development, marketing, advertising, and promotion agencies; and the immediate family members (spouse, partner, parent, child, sibling) and household members of any of them.

4. 4. How to Participate and How to Earn a Reward

   Requesting to host

   A couple requests to host by pairing their accounts and completing the host request (“Hero Survey”) in the App. Each week, Sponsor selects Hero Couples from the pool of requests based on factors such as available dinner capacity, neighborhood and timing coverage, the age ranges and preferences of singles on the waitlist, waitlist order, and past hosting history. Selection as a Hero Couple is at Sponsor’s sole discretion and is not guaranteed. Submitting a request creates no right to host or to a Reward. A couple may host only one active Swap at a time.

   Earning the Reward

   A Hero Couple earns one Reward for a Swap when all of the following are true, as determined from Sponsor’s records:

   • the Swap reaches at least 15 Qualified Singles before its invitation period closes;
   • at least one DatePals group dinner formed from that Swap takes place; and
   • neither partner has violated these Rules or the Terms of Service in connection with the Swap.

   Purchases do not count. Neither partner needs to buy a ticket, gift a ticket, sponsor a single’s dinner, or pay anything to earn a Reward, and no ticket gifting or other purchase by a Hero Couple counts toward the Qualified Singles threshold.

   Limits. One Reward per Swap. A Hero Couple counts as one participant and may earn no more than one Reward per calendar month, regardless of how many Swaps they host. Sponsor’s records of who joined a Swap, when, and through which link are final and binding.

5. 5. The Reward

   Each Reward is one gift card with a face value of $100 (approximate retail value $100) redeemable at a restaurant or restaurant group in the Chicago, Illinois area chosen by Sponsor. The specific restaurant or group may change from month to month and will be shown in the App or communicated when the Reward is delivered.

   • The Reward is not redeemable for cash and may not be exchanged, except that Sponsor may, in its discretion, substitute a reward of equal or greater value, including a gift card to a different restaurant or a prepaid card.
   • Gift cards are subject to the issuing restaurant’s own terms, including any expiration or usage terms printed on the card or in its terms of use. Sponsor is not responsible for lost, stolen, or unused gift cards after delivery.
   • No restaurant endorsement. Restaurants whose gift cards are offered as Rewards are not sponsors of, and are not affiliated with or involved in, the Program unless expressly stated otherwise on this page. Restaurant names and logos are the property of their respective owners.
   • One Reward is issued per Hero Couple per qualifying Swap and is delivered to the partner who submitted the host request unless the couple tells Sponsor otherwise in writing before delivery.

6. 6. Notification and Delivery

   Sponsor will notify a Hero Couple that has earned a Reward by text message, email, or in the App using the contact information on their accounts, and will deliver the Reward within 30 days after the date of the first group dinner formed from the qualifying Swap. Rewards are delivered as a digital gift card unless Sponsor arranges another method.

   Before delivery, Sponsor may ask the recipient to confirm eligibility and identity and, where required by law, to complete tax forms. If a recipient does not respond within 14 days of Sponsor’s request, or if the recipient cannot be reached using the contact information on the account, the Reward is forfeited and will not be reissued.

7. 7. Taxes

   Rewards are taxable income to the recipient. The recipient is solely responsible for all federal, state, and local taxes and for reporting the Reward as required by law. If the total value of Rewards a person receives from Sponsor in a calendar year reaches the threshold at which Sponsor is required to file an information return (such as IRS Form 1099-MISC), the recipient must provide a completed IRS Form W-9 or equivalent before further Rewards are delivered.

8. 8. Conduct and Disqualification

   Sponsor may disqualify a Hero Couple from the Program, withhold or cancel a Reward, and take action under the Terms of Service if either partner, or anyone acting with them:

   • creates or uses fake, duplicate, or borrowed accounts, or invites people who are not real single adults intending to attend a DatePals dinner;
   • pays, or offers anything of value to, people to join a Swap;
   • invites people under 18 or people they know are ineligible to use DatePals;
   • misrepresents the Program, the Reward, or DatePals when inviting others;
   • harasses, pressures, or spams people with invitations; or
   • otherwise violates these Rules or the Terms of Service.

   If Sponsor determines after delivery that a Reward was earned through conduct described above, Sponsor may require its return or offset its value against future Rewards. Sponsor’s decisions on eligibility, qualification, and disqualification are final.

   Be transparent when you share

   When you share your Swap invite link on social media or by message, you should let people know that you can earn a Reward from DatePals if they join. It is the honest thing to do, and it is what advertising rules expect when someone recommends a service they may be rewarded for promoting.

9. 9. Referrals by Singles

   Singles may share a referral link from the App inviting a couple they know to host a Singles Swap. A couple referred this way participates in the Program on the same terms as any other Hero Couple and is subject to these Rules. Unless Sponsor states otherwise in the App, the referring single does not receive a Reward or any other compensation for the referral.

10. 10. Changes, Suspension, and Termination

    Sponsor may change these Rules, including the Reward value, the Qualified Singles threshold, and the eligible area, by posting the updated Rules on this page with a new Last Updated date. Changes apply to Swaps whose invitation period opens after the change is posted and do not reduce or remove a Reward already earned. Sponsor may suspend or end the Program at any time if fraud, technical failure, or any other cause beyond Sponsor’s reasonable control impairs the integrity or proper operation of the Program, or as described in Section 2.

11. 11. Privacy

    Information collected in connection with the Program is used as described in our Privacy Policy, including to determine eligibility, count Qualified Singles, deliver Rewards, and comply with law. Sponsor will not publish a Hero Couple’s full names in connection with a Reward without their consent.

12. 12. General Conditions

    • Sponsor is not responsible for lost, late, misdirected, or undeliverable notifications; for technical failures of any kind, including problems with the App, invite links, text messages, or email; or for any error in the administration of the Program, except as required by law.
    • The Program is governed by the laws of the State of Illinois without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Program is subject to the dispute resolution and arbitration provisions of the Terms of Service.
    • If any provision of these Rules is held invalid, the remaining provisions stay in effect.
    • Sponsor’s failure to enforce any provision of these Rules is not a waiver of that provision.
